Welcome to Sawarigo. By accessing or using the Sawarigo website, Rider App, Captain App, or any related services, you agree to be bound by these Terms & Conditions. Please read them carefully before using our services.

1. About Sawarigo

Sawarigo is a technology platform that connects Riders with independent Captains/Drivers for transportation services including Bike, Auto and Car rides.

Sawarigo facilitates the booking and communication between Riders and Captains. The actual transportation service is provided by the Captain.

2. User Eligibility

To use Sawarigo services:

• You must provide accurate and complete information during registration.
• You must be legally eligible to use the selected service.
• You are responsible for maintaining the confidentiality of your account information.
• You must not use another person's account without permission.
• You must not use Sawarigo for any unlawful or fraudulent activity.

3. Rider Responsibilities

Riders agree to:

• Provide accurate pickup and destination information.
• Be available at the selected pickup location.
• Treat Captains and their vehicles respectfully.
• Follow applicable traffic and safety rules.
• Not carry prohibited, dangerous, illegal, or hazardous items.
• Not damage or misuse the vehicle.
• Pay the applicable fare and other charges shown during booking.

4. Captain Responsibilities

Captains using the Sawarigo platform agree to:

• Maintain valid driving and vehicle documents as required by applicable law.
• Provide accurate personal and vehicle information.
• Follow all applicable traffic and transportation regulations.
• Maintain their vehicle in a safe and roadworthy condition.
• Treat Riders respectfully and professionally.
• Follow the ride details displayed in the application.
• Not engage in unsafe, abusive, discriminatory, or unlawful behaviour.

5. Booking & Ride Confirmation

A ride request submitted through the Sawarigo application is subject to availability.

A booking is considered confirmed when the application displays a successful ride confirmation and/or a Captain accepts the ride.

Estimated pickup time, route, and fare may vary due to traffic, weather, road conditions, route changes, or other circumstances.

6. Fare & Payment

The applicable fare may depend on factors such as:

• Ride type
• Distance
• Duration
• Demand
• Applicable taxes and charges
• Other charges displayed in the application

Users agree to pay the amount applicable to the completed ride.

Sawarigo may offer different payment methods, including online payment and other supported payment options.

7. Cancellation

Riders and Captains may cancel a ride subject to the cancellation rules applicable at the time of booking.

A cancellation fee may be applicable depending on factors such as the time of cancellation, Captain's arrival, waiting time, or other applicable conditions.

The applicable cancellation charges will be displayed or communicated through the application where possible.

8. Waiting Time

The Captain may wait for the Rider for the applicable waiting period after reaching the pickup location.

Additional waiting charges may apply according to the fare rules displayed in the application.

9. Safety

Sawarigo is committed to providing a safe and reliable transportation experience.

Riders and Captains should follow applicable safety requirements and traffic laws at all times.

Riders should verify the Captain and vehicle details shown in the application before starting the ride.

In case of an emergency, users should contact the appropriate emergency services and may also use any safety or support features available through Sawarigo.

10. Prohibited Activities

Users must not:

• Use Sawarigo for illegal activities.
• Provide false or misleading information.
• Create multiple fraudulent accounts.
• Attempt to manipulate fares, bookings, ratings, or promotions.
• Harass, threaten, abuse, or discriminate against another user.
• Damage vehicles or property.
• Use the platform to distribute harmful or unlawful content.
• Attempt to interfere with or compromise the security of the Sawarigo platform.

11. Lost & Found

If a Rider leaves an item in a vehicle, the Rider should report it to Sawarigo support as soon as possible.

Sawarigo may assist in connecting the Rider and Captain regarding the lost item, but recovery of the item cannot always be guaranteed.

Users are responsible for their personal belongings during the ride.

12. Ratings & Reviews

After a ride, Riders and Captains may be allowed to provide ratings or feedback.

Users must provide honest and respectful feedback and must not submit false, abusive, threatening, or discriminatory reviews.

Sawarigo may remove content that violates its policies.

13. Promotions & Coupons

Sawarigo may provide promotional offers, coupons, discounts, or other benefits from time to time.

Each promotion may have its own eligibility requirements, validity period, usage limits, and terms.

Promotions may be modified, suspended, or withdrawn where permitted by applicable law.

14. Service Availability

Sawarigo aims to provide reliable services but does not guarantee that the platform or rides will always be available.

Services may be temporarily unavailable due to maintenance, technical issues, network problems, weather, traffic, government restrictions, or other circumstances beyond reasonable control.

15. Third-Party Services

Sawarigo may use third-party services such as payment providers, mapping services, communication services, analytics providers, or other technology providers.

The use of such services may be subject to the respective third party's terms and policies.

16. Limitation of Liability

To the extent permitted by applicable law, Sawarigo will not be responsible for losses or damages arising from circumstances beyond its reasonable control, including delays, traffic conditions, weather, network failures, actions of independent Captains, or events outside the platform's control.

Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.

17. Account Suspension or Termination

Sawarigo may suspend, restrict, or terminate an account if a user:

• Violates these Terms & Conditions.
• Provides false information.
• Engages in fraudulent or unlawful activity.
• Misuses the platform.
• Creates a safety or security risk.
• Violates applicable laws or regulations.

Users may also stop using the service at any time.

18. Privacy

Your use of Sawarigo is also subject to our Privacy Policy, which explains how we collect, use, store, and protect personal information.

19. Changes to These Terms

Sawarigo may update these Terms & Conditions from time to time.

Updated terms will be published through the Sawarigo website or application. Continued use of Sawarigo after an update means that you accept the revised Terms.

20. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the applicable laws of India.

Any disputes shall be subject to the jurisdiction of the appropriate courts, subject to applicable law.
